Such features are provided "as is" and may be modified, suspended, or discontinued at any time.

21. Security
Alpine Hire uses reasonable technical and organizational measures to protect the Services and Customer Data.
However, no system is completely secure. The Customer is responsible for maintaining secure access credentials, managing user permissions, and promptly notifying Alpine Hire of suspected unauthorized access or security incidents.
The Customer must not attempt to test, scan, attack, or bypass the security of the Services without prior written permission.
22. Warranties and disclaimers
The Services are provided on an "as is" and "as available" basis, except where expressly agreed otherwise in writing.
To the maximum extent permitted by law, Alpine Hire disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of:
- merchantability;
- fitness for a particular purpose;
- non-infringement;
- accuracy;
- availability;
- reliability;
- uninterrupted operation;
- error-free performance;
- hiring success;
- candidate suitability;
- commercial results.
Alpine Hire does not warrant that:
- the Services will meet all Customer expectations;
- all candidates will be qualified, available, or interested;
- candidate data will be complete, accurate, or current;
- AI-assisted outputs will be correct or unbiased;
- the Services will result in a successful hire;
- the Services will be free from errors, vulnerabilities, or interruptions.
23. Limitation of liability
To the maximum extent permitted by law, Alpine Hire will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of revenue, loss of business opportunity, loss of goodwill, loss of data, hiring delays, candidate rejection, failed hires, employment disputes, or business interruption.
To the maximum extent permitted by law, Alpine Hire's total aggregate liability arising out of or relating to the Services, these Terms, or any related agreement will not exceed the fees paid by the Customer to Alpine Hire for the relevant Services during the twelve months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law.
24. Indemnification
The Customer agrees to indemnify and hold Alpine Hire harmless from claims, damages, losses, liabilities, costs, and expenses arising out of or related to:
- Customer's use of the Services;
- Customer Data;

- Customer's hiring decisions;
- employment-related claims involving the Customer;
- violation of applicable laws by the Customer;
- violation of these Terms by the Customer;

- the Customer's use creates security, legal, or operational risk;
- Alpine Hire is required to do so by law;
- continued access may harm Alpine Hire, candidates, customers, users, or third parties.
Where reasonable, Alpine Hire will provide notice and an opportunity to remedy the issue before suspension.
26. Term and termination
These Terms remain in effect while you access or use the Services.
Subscriptions, order forms, service agreements, or statements of work may have their own term and termination provisions.
Unless otherwise agreed in writing, either party may terminate a free account or unpaid access at any time.
Alpine Hire may terminate or suspend access immediately if the Customer materially breaches these Terms, fails to pay fees, violates applicable law, or creates security, legal, or reputational risk.
Upon termination:
- the Customer's right to access the Services ends;
- outstanding fees become due;
- Alpine Hire may delete or return Customer Data according to the applicable agreement, data processing agreement, or retention policy;
- provisions intended to survive termination will remain in effect.
27. Effects of termination
After termination or expiration of paid Services, Alpine Hire may retain Customer Data for a limited period to allow export, comply with legal obligations, resolve disputes, enforce agreements, or maintain business records.
The Customer is responsible for exporting any required data before termination, unless otherwise agreed.
Alpine Hire may delete Customer Data after the applicable retention period, unless legally required to retain it.
Sections concerning confidentiality, intellectual property, fees, data protection, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution survive termination.
28. Publicity
Unless otherwise agreed in writing, Alpine Hire may identify the Customer as a customer using the Customer's name and logo in sales materials, website references, investor materials, and customer lists.
The Customer may request removal of its name or logo by contacting Alpine Hire. Alpine Hire will process reasonable removal requests within a reasonable period.
For case studies, testimonials, or detailed public references, Alpine Hire will request separate permission.
29. Non-solicitation
If agreed in a specific service agreement, the Customer may be restricted from directly engaging candidates introduced by Alpine Hire outside the agreed process for a defined period.
Any candidate ownership period, introduction period, non-circumvention obligation, or placement fee obligation applies only if expressly stated in a signed agreement, order form, or proposal.
Without such written agreement, these Terms do not create an automatic candidate ownership or non-solicitation obligation beyond applicable confidentiality and data protection duties.
30. Force majeure
Alpine Hire will not be liable for failure or delay caused by circumstances beyond reasonable control, including natural disasters, war, terrorism, labor disputes, internet failures, power outages, cyberattacks, government actions, pandemics, supplier failures, infrastructure outages, or third-party service disruptions.

Alpine Hire may update these Terms from time to time.
If we make material changes, we will provide notice through our website, platform, email, or other appropriate channels.
The updated Terms will become effective on the date stated at the top of the Terms or as otherwise notified.
Continued use of the Services after the effective date means that you accept the updated Terms.
33. Assignment
The Customer may not assign or transfer these Terms or any rights or obligations under them without Alpine Hire's prior written consent.
Alpine Hire may assign these Terms in connection with a merger, acquisition, corporate restructuring, financing, sale of assets, or transfer of business.
34. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect.
The invalid provision will be replaced by a valid provision that most closely reflects the original commercial and legal intent.
35. No waiver
Failure by Alpine Hire to enforce any provision of these Terms does not constitute a waiver of that provision or any other rights.
Any waiver must be in writing and signed by Alpine Hire.
36. Entire agreement
These Terms, together with any applicable order form, service agreement, statement of work, data processing agreement, privacy policy, or written agreement, form the entire agreement between the parties regarding the Services.
They replace any prior discussions, proposals, understandings, or agreements relating to the same subject matter.
37. Governing law and jurisdiction
These Terms are governed by the laws of Switzerland, without regard to conflict of law principles.
